FILMON SURRENDER IN AMERICA
To avoid more inane lawsuits and one that is clearly rigged, we have decided to take down the Major Broadcasters in Washington DC and replace them with Independent stations. Something we will be doing all across the United States where we are currently offering Major Network TV

Re: FILMON SURRENDER IN AMERICA
ANOTHER COURT CASE ....
FilmOn.com, Inc. Issues Response Regarding New York Southern District Court's Ruling on CBS Broadcasting, Inc., et al v. FilmOn.com, Inc., Temporary Restraining Order
FilmOn.com Inc. CEO and Chairman, Alki David today issued the following statement regarding the ruling made by the New York Southern District Court, which issued a temporary restraining order, in effect pending the court's decision on if it will issue a preliminary injunction.
"We respect the Court's decision in this matter and have temporarily ceased retransmission of free network television on FilmOn. In the few weeks FilmOn provided free access to basic television on consumers' mobile devices, it received more than 30 million individual users. We also garnered dozens of positive reviews about our free service's quality and ease of use. We have, in essence, shown full proof of concept of the FilmOn delivery system-proving that millions of viewers will watch our superior television service online, all with commercials, adding millions of extra impressions that enhance network's value to its viewers and advertisers."
"FilmOn has succeeded in securing partnerships with several independent broadcast channels to be able to keep a compelling live offering online in the near future. Coupled with our own library of content and that of our partners, FilmOn will remain open for business."
We do expect to bring the major networks back to our lineup in the near future, all in a legitimate and collaborative business model. We have already begun very positive discussions with TV networks affiliates and other content owners to provide our delivery service and measurement analytics to stream their live content online.
Scott Zarin, Zarin & Associates P.C., legal counsel for FilmOn.com FilmOn added:
"In addressing FilmOn's argument that it is exempt from copyright infringement liability as a cable system, the court indicated that it was not convinced -- on the facts currently known to it -- which this is the case. Although the court issued a Temporary Restraining Order, it is providing FilmOn with an opportunity to elaborate upon its 'cable system' argument more thoroughly in a hearing on the Networks' request for a preliminary injunction
"FilmOn will be drafting papers in opposition to the Networks' motion for a preliminary injunction in the coming weeks, with which it expects to submit to the court the opinion of an expert on FilmOn's technology in order to demonstrate that FilmOn is indeed a cable system. If FilmOn successfully opposes the Networks' motion for a preliminary injunction, the court's Temporary Restraining Order -- which by law can only remain in effect for a short duration -- will be dissolved."

Re: FILMON SURRENDER IN AMERICA
nothing happened
n a statement, Fox said, “We are pleased, but not surprised, that that the court recognized that the commercial retransmission of our broadcast signal without permission or compensation is a clear violation of the law. This decision should finally put the matter to rest, and will hopefully discourage other illegal services from attempting to steal our content.”
"[T]he Copyright Act and, in particular, the Transmit Clause are clear: 'FilmOn X transmits (i.e., communicates from mini-antenna through servers over the Internet to a user) the performance (i.e., an original over-the-air broadcast of a work copyrighted by one of the Plaintiffs) to members of the public (i.e., any person who accesses the FilmOn X service through its website or application) who receive the performance in separate places and at different times (i.e., at home at their computers or on their mobile devices)
U.S. District Judge Rosemary M. Collyer refused FilmOn X’s request to set aside an injunction as it pursues an appeal or to roll back the scope of her order prohibiting the company from offering the unauthorized broadcast station feeds in almost the entire U.S. Last week, Collyer ruled that the offerings of FilmOn X’s D.C. service were public performances in violation of the Copyright Act, and she extended an injunction not just in the nation’s capital but in all other jurisdictions save New York.
That’s three legal losses in a row for FilmOn X in a week. Today the D.C. District Court denied emergency stay motions by the company and its CEO Alki David against an almost nationwide injunction from a case launched by Fox Television Stations, ABC and NBC. The free-TV-over-the-Internet company was trying to stop the September 5 ordered preliminary injunction from taking effect, to have it modified it so that it covered only the court’s direct jurisdiction and to increase the amount of the bond form $250,000 to 2.75 million. The judge said No all round. “FilmOn X’s arguments are not persuasive.
The judge also ruled that the company and the billionaire digital media entrepreneur had to take down, as agreed in the July 2012 settlement, sites likewww.cbsyousuck.com and remove other online material slagging and attacking the broadcaster.
“FilmOn and David are hereby ordered to forthwith deliver to plaintiffs’ counsel the sum of $1,350,000, plus interest at the statutory rate, the costs of collection, and reasonable attorneys’ fees,”
SINGING IN THE SHOWER
"The only type of performance that is enabled by FilmOn X is private,” said FilmOn X laywer Ryan Baker.
But content creators aren't buying it.
“When someone inserts themselves as a middleman and tries to make a profit, licenses should be obtained,” Robert Garrett, a lawyer for Comcast Corp.’s NBC, told the judges. “Singing in the shower is a private performance. Sending transmissions to 50,000 customers is not singing in the shower.”

Re: FILMON SURRENDER IN AMERICA
also the ´´bbc´´ aerial system could be off the air in about 30 days as the replacement satellite service will not cover tenerife ....the only option for british tv would be the internet ...
(this will not affect those people not on the island of tenerife)
