M5 bonfire accident.

So, your house catches fire cos you left the toast to long in the toaster, guy driving down the road outside the house drives in to the smoke, mounts the pavement and kills a kid, oh it’s your fault, but your defence, the toaster timer failed, so it’s the manufacturers fault, but the manufacturer only guaranteed the toaster for a year and its now three years old, so it’s still your fault as you failed to maintaining the toaster... Yes/No ??????
Or another scenario, I’m in my new car (still under warranty), driving down the road at midnight, the lights fail but I keep driving, the cops stop me and charge me for driving with no lights, I go to court and explain that it not my fault the lights failed etc, etc,............... Don’t think so...
